TERMS OF SERVICE
MAILING SERVICES
Prices are quoted based on the information located on website, unless
specifically stated otherwise in the written quotation. Prices quoted are based
on specs given at the time of the request for quotation and are subject to
review when pieces have been received. To avoid any misunderstanding, all
mailing services instructions should be in writing. Instructions not provided in
writing may lead to problems for which we cannot be responsible. Mailing service
turn-around time can not be guaranteed.
Delivery Timing
If you are mailing a time dated piece, be sure to include requested delivery
date when placing your order. Standard (Bulk, 3rd Class) is the most cost
effective way to deliver your mailer however will take longer than First Class,
if your mailer is a time sensitive piece, you may want to consider First Class.
Order Approval
Customer is fully
responsible for final proof and layout approval prior to the printing process.
Print Brokers USA is NOT LIABLE for errors in a final product caused by any of
the following reasons:
Misspelling, Graphics, Bleeds, Grammar, Damage Fonts, Uneven-Borders, Punctuation, Wrong cuts,
Incorrect or Missing Folds or Finished Product Size.
Postage Requirements
To allow sufficient time for payment deposit with the USPS, when you use our
permit number, we require that all checks and credit card payments for postage
be in our possession three days before your mail date. If a postage deposit is
not received, we cannot advance the postage required, and the U.S. Postal
Service will not accept your mail. UNDER ABSOLUTELY NO CIRCUMSTANCES WILL
POSTAGE BE REFUNDED FOR ANY REASON ONCE A JOB HAS BEEN MAILED BY THE U.S. POST
OFFICE. Please make certain that you have advanced adequate postage to cover
your entire mailing, including international fees. When using your own permit,
funds must be deposited the day prior to the scheduled drop date and a copy of
the postal receipt faxed to our office. If funds have not been deposited,
causing us to bring the mail back, you will be charged a trip fee.
Limitations of Liability
for Mailing Services
OUR LIABILITY FOR ANY ERROR, MISTAKE, OR FAILURE TO PERFORM SERVICES HEREUNDER
IS EXPRESSLY LIMITED TO THE VALUE OF THE WORK PERFORMED.
UNDER NO CIRCUMSTANCES
SHALL WE BE LIABLE TO ANY CUSTOMER FOR SAID CUSTOMER’S LOSS OF BUSINESS, LOSS OF
PROFITS, POSTAGE OR OTHER CONSEQUENTIAL DAMAGES SUFFERED BY SUCH CUSTOMER AS A
RESULT OF ANY ERROR, MISTAKE, OR FAILURE OF US TO PERFORM SERVICES.
Cancellations
Canceled orders require compensation for incurred costs and related obligations
at the time of cancellation. Due to the speed of our turnaround, you may only
cancel a job the same business day you place your order (via e-mail). A minimum
charge of $95 is applied to jobs canceled before 3pm
eastern standard time the day of eproof approval.
A minimum charge of $150 is applied to jobs canceled before 6pm eastern standard time
the day of eproof approval. No refunds will be given for orders canceled after
6pm eastern standard time of the same business day the order was placed.
Liability
Print Brokers USA liability shall be limited to the stated selling price to the
customer of any defective goods, and shall in no event include special,
consequential, incidental, indirect or similar damages, including without
limitation, lost profits due to poor turn-around time. IT IS EXPRESSLY
AGREED THAT THIS WARRANTY IS IN LIEU OF ALL WARRANTIES OF FITNESS FOR PARTICULAR
USE AND MERCHANTABILITY. Print Brokers USA makes no other warranty and no
actions or words of Print Brokers USA or its officers, employees or agents shall
constitute a warranty.
Color Proofing and Matching
Print Brokers USA is not liable for color matching or ink density on screen
proofs approved by the customers. Screen proofs will predict design layout, text
accuracy, image proportion and placement, but not color or density.
Print Brokers USA will try it's best to match the gradient density of each color
, Print Brokers USA is not liable for the final appearance of a color.
Application of UV Coating may effect or change the appearance of the printed
colors. Print Brokers USA is not liable for the final color appearance of a UV
product/s.
Claims
Claims for defects, damages, or shortages must be made by the client in writing
no later than 2 calendar days after project is received. If no such claim is
made, Print Brokers USA and the client will understand that the job has been
accepted. By accepting the job, the client acknowledges that Print Brokers USA’s
performance has fully satisfied all terms, conditions and specifications.
Returns and Refunds
Since each order is unique to customer and has no re-sale value, All Sales Are
Final. If we verify that we made an error, we will re-print the order. No
Refunds or Credit.
Customer must notify Print Brokers USA within 3 business days of order
acceptance as verified by local delivery or through other tracking information
(FedEx, UPS, etc...) to notify any defects discovered in the ordered product. In order to
receive replacement Customer must return 100% of the received product within 10
days (on their own expense) from the time when the ordered product delivery was
taken.
All charges related to expedite printing (Rush Printing or Shipping) are NOT
REFUNDABLE, including for those orders that are returned for any reason.
Disputes & Venue
For legal purposes, the venue for any dispute shall be Palm Beach County,
Florida, USA
Emailed and Custom Quotes
All verbal special requests and emailed quote requests will receive a quote that
is valid for at least 30 days from when the completed quote is provided.
Should pricing change prior to the 30 days we will provide you with updated
pricing before or upon placing your order. All pricing is subject to
change.
Orders
Placed, Emailed Proofs and Trimming
By placing an order or paying for an order it is understood that you have read
the Print Brokers USA - Terms of Service in full and agree to the content of
these terms. All orders once submitted will be reviewed by our graphics
department for accuracy and quality. After this review we will email you
back with your proof. You must then reply to the email with the attached
proofs, with your approval. All emailed proof approvals are considered
final. Additionally, please note that we do not guarantee even cutting of
borders. We recommend no borders due to shifting in the cutting process
creating borders that may appear uneven. Please take this into
consideration when you place your orders.
Right to Subcontract
Print Brokers USA shall have the right to assign any portion of the work
required to another contractor.
ORDER SHIPPING AND
DELIVERY
Print Brokers USA will always
act to make sure that any production difficulties do not delay delivery
schedules. In no case shall Print Brokers USA be liable for any consequential or
damages resulting from any delay in shipment or delivery.
All Print Brokers USA customers agree not to hold Print Brokers USA liable for
delays in shipments caused by weather conditions, shipping company delays,
international customs issues or any other circumstances beyond our direct
control. Print Brokers USA shipment and delivery dates are calculated based upon
estimates provided by our suppliers and are not under our direct control.
Print Brokers USA will always act to make sure that delivery schedules are met.
However, unexpected equipment failure, malfunction and or technical problems may
delay the printing process. In case of delay caused by technical difficulty,
rush charges/fees will be refunded or waived where applicable. However,
technical difficulty will not be the grounds for order cancellation.
